These General Terms of Sale are governed by the Consumer Code (D. Lgs. No. 206/2005), Section II, Distance Contracts (Articles 50 to 67) as amended by EU Directive 2011/83 transposed by legislative decree of December 3rd 2013 and e-commerce policy (Legislative Decree No 70/2003) and apply to the sale of the Products by Internet, as identified and listed on the Website. The Customer is invited to print or keep these General Terms as they prefer. In case of changes in the General Conditions, the purchase order (hereafter "Purchase Order") will be subject to the General Conditions published on the Website during sending of the Order by the Customer. By sending the order, the Customer declares that has read, understood and accepted these Terms of Sale.

The following sale conditions govern distance purchasing of goods offered on the hydraclothing.com website. Through the forwarding of their order on the website, the customer accepts the following conditions and declares to have seen them.

1) Shipments

hydraclothing.com works with the best companies in the industry to ensure that your order is delivered on time.

The shipment will be made after receiving the payment.

Delivery times may change if the recipient's address is located in a remote and/or island area.

Factors such as postal or carrier delays, logistical problems, adverse weather conditions or the inability of our carriers to reach the recipient, at the delivery address provided at the checkout order, for incomplete or inaccurate data, can also affect the punctuality of deliveries.

We do our best to ensure that orders are delivered within the scheduled dates, but on rare situations, there may be delays in deliveries, particularly during some busy periods (sales and holidays).

Any delays or non-deliveries by the courier are not directly imputable to Goccia srl.

We will do everything possible to keep you updated regarding the delivery and you will still be able to follow the path of your package through the shipping number to be entered on the courier's website.

We do not ship to mailboxes but only to physical addresses.

Italia Free delivery (within 3-5 days)

Spain 14.90€ (within 3-5 days)

France 9.90€ (within 5-7 days)

Germany 9.90€ (within 5-7 days)

2) Prices

The prices of the products on display are Vat included and can be changed at any time.

In addition, before checkout, the total cost of the order will be summarized before payment, which can be changed or cancelled in full.

3) Liability and guarantee

Goccia srl is not responsible for any damage or loss, direct and/or indirect, resulting by the sale of the items proposed in the published catalog, neither for delay and\or non-delivery of the product, nor for any other fact not directly attributable to our company.

Goccia srl assumes no responsibility for loss of objects after delivery, nor for damage due to the use of clothing, footwear and accessories.

The warranty terms applied are those provided by the manufacturer. It is the Customer's responsibility to verify the quantity and good condition of the goods at the time of delivery.

If the Customer finds that the goods are damaged or do not comply with the quantities ordered, then the same must report it to the carrier and sign the delivery document with reservation as well as inform Goccia srl within 3 days from the receipt of the shipment. Goccia srl in this case will provide (verified that the Product(s) subject to Cancellation is/are intact, inserted in the original packaging with all its parts, including packaging and ancillary documentation) to the possible replacement of the missing or damaged goods and in accordance with the Purchase Order made.

4) Payments

Payment for your order can be made in the following method:

PayPal – 100% fast and safe

Credit Card – Secure payment on a PayPal system

Cash on delivery (only for Italy) – Cash payment to the courier; additional cost of €5,90;

5) Returns and refunds

Pursuant to Legislative Decree no. 206/2005, the customer is entitled to cancellation within 30 days from the receipt of the order.

The return is only free in Italy.

Abroad returns is not free and it is charged to the customer.

The return for a size change is free in Italy only the first time. For any subsequent size changes is charged to the customer.

To request the return send an email to hydra@hydraclothing.com with the order number, reason for the return and any change of size required.

The returned product must be intact, undamaged, unused or washed, with the original label and box where it was.

In case of return, the refund will be issued within 14 days from receipt of the return. All incidental expenses paid (standard or express shipping and the cost of the card) are excluded from the refund.

The shipping costs for returns of customers residing outside Italy are charged to the customer himself.

6) Product Availability

hydraclothing.com reserves the right to accept or not the orders that will be placed , until stocks are exhausted. In case of non-acceptance of the order (e.g. item not available), following an information email, we will propose the reaccreditation of any amounts paid or the choice of an alternative product.

7) Technical Information

The technical information entered in the product sheets is derived from the information made known by the manufacturer.

Therefore hydraclothing.com reserves the right to modify/adapt, where it considers it appropriate for descriptive purposes, the technical information of the products in the catalogue.

8) Confidential data

Your credit card details are managed by the PayPal. There’s no way Goccia srl and those who operate there become aware of this information.  If you choose PayPal as your payment method, please read the terms of service on the reference site carefully.

10) Alternative dispoute resolution (ADR) /Online dispoute resolution (ODR)

EU Regulation No. 524/2013 and Legislative Decree No. 130/2015 have introduced legislation aimed at promoting the out-of-court settlement of disputes between consumers and traders relating to a product or service purchased online. For this reason, an European platform of Online Dispute Resolution (so-called ODR platform) has been created, which can be consulted at http://ec.europa.eu/consumers/odr/. Through the ODR platform the consumer can send a complaint related to a contract concluded online with Goccia srl. In this regard, Goccia srl points out that its e-mail address is hydra@hydraclothing.com

There are 4 steps:

– creation and submission of the complaint
– agreement on the resolution body
– processing of the complaint by the ADR entity.
– resolution and closure of the complaint.

11) Applicable law, jurisdiction and legislation for non-consumer users

These Terms are subject to Italian law. For all orders from people not qualifying as "consumers", all disputes relating to the interpretation and/or execution of this contract will be the exclusive competence of the Court of Tivoli.

For consumer, the competent court remains the consumer's court.
